Subject: | Ensuring Victims Receive Compensation in Pennsylvania |
In the near future, I plan to introduce legislation that will assist victims in receiving the compensation they are entitled to under existing law. The Violence Against Women Act has been reauthorized and strengthened four times since its original passage in 1994. The Violence Against Women Act Reauthorization Act of 2022, passed Congress and was signed by President Biden in a bi-partisan fashion. One of the provisions in the most recent reauthorization is the Fairness for Rape Kit Backlog Survivors Act of 2022. This provision requires that every state amend their crime victim compensation program by March 15, 2025, to provide a waiver for any application filing deadline for a victim due to a delay in the testing of a sexual assault forensic examination kit. My legislation will amend the Crime Victims Act to provide the waiver necessary to ensure victims are not denied compensation due to a backlog in testing and make certain the Commonwealth is in compliance with federal law.
