MEMORANDUM

Posted: June 5, 2023 01:49 PM
From: Senator Tracy Pennycuick
To: All Senate members
Subject: Website ADA Compliance

In the near future, I plan to introduce legislation that ensures business owners receive a fair and reasonable timeframe to make their websites ADA-compliant.

Websites operated by business establishments or public entities must conform to ADA regulations to ensure that all residents of the Commonwealth can have access. Despite its well-meaning and important purpose, there have been many instances of extortionary practices, in which lawsuits are filed against businesses to obtain settlements.

Given that regulations surrounding website compliance are still vague, business owners should be afforded a grace period in which they can modify their sites to conform to ADA regulations.

My legislation will provide the owner/entity 60 days to respond to a notice of website access compliance issues. If the business does not respond or make corrective action, then legal action already enshrined in law can commence.

This measure will ensure that organizations, especially small businesses, have the opportunity to correct deficiencies and provide equal access to their websites and prevent actors with ill intent from gaming the system.

I hope you will join me in cosponsoring this worthwhile legislation. Should you have any questions, please contact Matt Szuchyt in my office.
