Subject: Placement of Crossover Alcoholic Beverages
 
A growing number of beverage companies now sell alcoholic drinks that closely resemble the traditional, non-alcoholic versions of their juice and soda products. Some of these new crossover products share the same name and branding between both the alcoholic and non-alcoholic versions of the beverage. Others bear the same or similar imagery as the non-alcoholic product but include various indicators that the product contains alcohol.

When these crossover alcoholic products are placed on shelves or displays immediately adjacent to their soft-drink counterparts, it can lead to confusion between the alcoholic product and the non-alcoholic version. To ensure the proper display of such products and the safety of consumers—particularly underage consumers—I plan to introduce legislation that would regulate the display of beer, flavored malt beverages, or wine products that closely resemble similarly branded non-alcoholic products.
 
My legislation would amend the Liquor Code to:
 
  • Prohibit licensees from placing beer, flavored malt beverages, or wine products in an area immediately adjacent to non-alcoholic beverages containing the same or similar brand name, logo, or packaging as the alcoholic beverages.
     
  • Require licensees to equip displays of crossover products with signage that indicates the product is an alcoholic beverage, is clearly visible to consumers, and is of sufficient size to notify the consumer that the product contains alcohol.
