MEMORANDUM

Posted: October 2, 2023 09:23 AM
From: Representative Jim Gregory
To: All House members
Subject: Catch a Sexual Predator Amendment to the Wire Tap Act

In the near future, I intend to introduce another important piece of legislation to help law enforcement deter and combat child sex abuse.  Specifically, my legislation would create an exception to the Wiretap Act to allow any individual to intercept the conversations of child predators for the purpose of enforcing existing sex offenses under Chapters 30 (relating to human trafficking) and 31 (relating to sex offenses).  Significantly, before an individual can intercept an oral communication under my bill, the individual must first possess a reasonable belief that an adult has engaged, or intends to engage, in sexual conduct with a child.   This legislation will serve as a companion to HB 1660, which seeks to allow any individual to assume the identity of a minor for the purpose of catching and identifying online predators who solicit sex from minors over the internet.

By allowing any individual to record and intercept the oral statements of child predators, we can help deter and prevent child sex abuse in our communities.  Please join me in co-sponsoring this legislation to better protect and serve our Commonwealth residents.

Introduced as HB1744
