Subject: Pharmacy Benefit Manager Anti-Steering
 
Over the last few years, Pennsylvania has taken important steps in fighting some of the practices of pharmacy benefit managers (PBMs) that keep costs high for consumers. We will be introducing legislation to further tighten rules around PBMs.
 
First, our legislation will prevent PBMs from steering patients to their affiliated pharmacies by restricting or limiting the number of visits patients can make to other pharmacies, using variable copays, or requiring the use of mail order pharmacies. Second, our bill would require all Medical Assistance contracts with PBMs to reimburse the same rates to all pharmacies in a network. Last, our bill will require PBMs to reimburse pharmacies at Centers for Medicare and Medicaid Services National Average Drug Acquisition Cost rates.
 
Taken together, these provisions will allow patients to use the pharmacies most convenient for them, keep rates down across networks, and prevent price gouging by following national drug price averages.
